Terms of Service

By accessing or using ArcaTrust, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. You must be at least 18 years of age to use ArcaTrust.

ArcaTrust is a personal finance management platform that provides budgeting, expense tracking, and AI-powered financial insights for households.

ArcaTrust is NOT a bank, registered investment advisor, financial planner, or tax advisor. Nothing provided through ArcaTrust constitutes financial, investment, tax, or legal advice. Always consult qualified professionals for financial decisions.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. One account per individual; account sharing is prohibited.

ArcaTrust offers a 14-day free trial with no credit card required. After the trial period, you will be charged $25.00 per month (or the then-current price) unless you cancel before the trial ends.

• Subscriptions automatically renew each billing period
• You may cancel at any time from Settings > Billing
• Upon cancellation, you retain access until the end of your current billing period
• No prorated refunds are issued for partial months
• Additional Plaid bank connections beyond the included 30 are billed at $1.00 per connection per month
• Price changes will be communicated via email at least 30 days in advance
• If your payment method fails, we will attempt to charge it up to 3 times over 7 days before suspending your account
• Suspended accounts retain data for 90 days
• Promotional discounts, if applied, are honored for their stated duration

You agree not to:

• Use ArcaTrust for any illegal purpose
• Share your account credentials with unauthorized persons
• Attempt to reverse engineer, decompile, or disassemble the application
• Use automated scripts, bots, or scrapers to access the service
• Upload malicious files or attempt to exploit security vulnerabilities
• Create multiple free trial accounts to avoid payment
• Impersonate another person or misrepresent your identity
• Use the service to store or transmit content that infringes intellectual property rights
• Interfere with or disrupt the service or servers
• Use the service for commercial purposes without written consent

ArcaTrust connects to your financial institutions via Plaid, a trusted third-party provider. All bank connections are strictly read-only — we cannot initiate transactions, transfers, or any other monetary actions. By connecting your accounts, you authorize ArcaTrust and Plaid to access your financial data solely for the purpose of providing the service. Plaid's own terms of service and privacy policy also apply to your use of their services.

ArcaTrust uses AI technology (powered by Anthropic Claude) to provide features including but not limited to: financial coaching, transaction categorization, spending insights, tax optimization suggestions, insurance analysis, anomaly detection, and weekly recaps. By using AI features, you acknowledge that:

• AI-generated content is for informational purposes only and does not constitute financial, tax, legal, or investment advice
• AI responses may contain errors, inaccuracies, or outdated information
• You should independently verify any AI-generated information before acting on it
• Your prompts and financial data are sent to our AI provider (Anthropic) for processing but are not used to train AI models
• AI usage is subject to monthly limits as described in your subscription plan
• We may modify, limit, or discontinue AI features at any time

ArcaTrust and its original content, features, and functionality are owned by ArcaTrust and are protected by copyright, trademark, and other intellectual property laws. You retain full ownership of your personal and financial data. By using the service, you grant us a limited, non-exclusive license to process your data solely to provide and improve the service.

Your use of ArcaTrust is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

ArcaTrust is provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for financial decisions made based on information provided by the service
• We are not responsible for the accuracy of data synced from your financial institutions
• Our total liability is limited to the fees you paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages

ArcaTrust strives to maintain continuous service availability, but we do not guarantee uninterrupted or error-free access. The service may be temporarily unavailable due to:

• Scheduled maintenance (we will endeavor to provide advance notice via email or in-app notification)
• Emergency maintenance required for security patches or critical bug fixes
• Third-party service outages, including Plaid (bank connections), Stripe (payment processing), and cloud infrastructure providers
• Events beyond our reasonable control, including natural disasters, power outages, internet disruptions, cyberattacks, or acts of government (force majeure)

During periods of unavailability:

• We will use commercially reasonable efforts to restore service as quickly as possible
• We are not liable for any losses, damages, or missed financial deadlines resulting from service downtime
• No credits, refunds, or extensions will be provided for periods of unavailability unless downtime exceeds 72 consecutive hours, in which case affected subscribers may request a prorated credit
• Bank connection syncing may be delayed; transactions will backfill automatically once service is restored

We reserve the right to modify, suspend, or discontinue any part of the service at any time with 30 days written notice for material changes. In the event of a permanent discontinuation of the entire service, we will provide at least 90 days notice and the ability to export all your data.

While ArcaTrust endeavors to display accurate financial information, we cannot guarantee the accuracy, completeness, or timeliness of data received from your financial institutions via Plaid or entered manually. You are solely responsible for verifying the accuracy of your financial data. ArcaTrust is not responsible for errors in bank-reported transactions, balances, or account information. AI-generated categorizations, insights, projections, and recommendations are approximations and should be independently verified.

ArcaTrust is not directed to individuals under 18 years of age. We do not knowingly collect personally identifiable information from children under 18. The Kids Mode feature is designed for use by parents to manage allowances and education for their children — the parent maintains the account and enters data on behalf of the child. Children should not create their own ArcaTrust accounts. If we learn we have collected personal information from an individual under 18, we will delete that information promptly. If you believe a child under 18 has provided us personal information, please contact us at info@arca-trust.com.

As the household administrator, you may invite other members to your ArcaTrust account. By adding household members, you acknowledge and agree that:

• All household members will have access to shared financial data as permitted by their assigned role and permissions
• You are responsible for obtaining consent from household members before adding their financial information
• ArcaTrust is not responsible for disputes between household members regarding shared financial data
• Removing a household member does not automatically delete their data from the household — the admin must manage this separately

You may grant read-only access to financial professionals (advisors, CPAs, attorneys) through the Advisor Portal. By doing so, you authorize ArcaTrust to share your financial data with the designated professional. ArcaTrust does not verify the credentials, qualifications, or licensing of financial professionals listed in the Advisor Marketplace. The Advisor Marketplace currently features only verified Vanguard representatives. ArcaTrust does not endorse, recommend, or guarantee the services of any financial professional. Any advice or services provided by a financial professional are solely between you and that professional.

You agree to indemnify and hold harmless ArcaTrust, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Any financial decisions you make based on information provided by the service

Either party may terminate the agreement at any time. You may cancel your subscription through your account settings. Upon cancellation, you retain access until the end of your current billing period. Your data is preserved and you may resubscribe at any time.

You may permanently delete your account at any time from Settings. Upon deletion, all personal and financial data is permanently removed from our systems. Active subscriptions are automatically cancelled upon account deletion. This action is irreversible — we cannot recover deleted data.

We may suspend or terminate accounts that violate these terms. Upon termination by us, your data will remain available for export for 30 days.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the service at least 30 days before the changes take effect. Your continued use of ArcaTrust after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the service.

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of ArcaTrust shall be resolved through binding arbitration administered in Salt Lake City, Utah.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of ArcaTrust shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall be conducted in Salt Lake City, Utah, or remotely at your election. Each party shall bear its own costs of arbitration.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

SMALL CLAIMS EXCEPTION: Either party may bring qualifying claims in small claims court.

OPT-OUT: You may opt out of this arbitration provision by sending written notice to info@arca-trust.com within 30 days of creating your account.

ArcaTrust is a financial management tool designed to help you organize, track, and understand your personal finances. ArcaTrust does NOT provide financial, investment, tax, or legal advice.

The information, AI-generated insights, projections, and tools provided through ArcaTrust are for informational and educational purposes only and should not be relied upon as a substitute for professional financial, tax, investment, or legal advice. You should consult with qualified professionals before making financial decisions. ArcaTrust is not a registered investment advisor, broker-dealer, tax preparer, or financial planner. Past performance data shown in the app does not guarantee future results. Budget projections and forecasts are estimates only.

You own your financial data. ArcaTrust provides tools to export your data at any time:

• Transaction history (CSV export)
• Budget templates and targets (CSV export)
• Account summaries and net worth history

Upon account deletion, all data is permanently removed within 30 days. We do not retain copies of deleted data beyond what is required by law. You may request a complete export of all your data by contacting info@arca-trust.com.

By creating an ArcaTrust account, you consent to receive electronic communications from us, including: account notifications, billing receipts, security alerts, product updates, and optional marketing communications.

You may opt out of marketing communications at any time from Settings > Notifications or by clicking Unsubscribe in any email. Transactional emails (security alerts, billing receipts, account changes) cannot be opted out of while your account is active.

ArcaTrust may contain links to third-party websites, services, or applications (including Plaid, Stripe, and financial institution websites). We are not responsible for the content, privacy practices, or terms of any third-party services. Your interactions with third-party services are governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party service you access through ArcaTrust.
